1.3 By browsing the Website, or placing orders, You agree to our Terms and Conditions as we have set out below, which binds a legal agreement between Us and You for the supply of goods.
1.4 The agreement together with your order constitutes the entire agreement between Us and You for the supply of products. This cannot be varied unless we agree to vary it in writing or by email.

6. Placing Orders
6.1 Orders may be placed by following the instructions on the website.
6.2 Orders will be verified once you have received a confirmation email from Walker Bay (Aust) to your nominated email address.
6.3 Walker Bay (Aust) is an online store and will primary communicate with customers via email and telephone.
6.4 Walker Bay (Aust) places the responsibility onto the customer to ensure that all details have been filled out correctly when placing an order, and to regularly check the nominated email address for correspondence.
6.5 In the event of an order being cancelled a refund will be given in full as soon as practicable, a confirmation of the refund will be sent to the nominated email address.
6.6 Walker Bay (Aust) will not be liable for any delay in performing any of our obligations under this agreement if circumstances are beyond our control, Walker Bay (Aust) shall also be entitled to a reasonable extension of time for the performance of such obligations.
7.1 Your can use a approved (Visa or Mastercard) to make purchases.
7.2 Payment will not be processed until we confirm via email that the products are in stock.
7.3 Payment will be taken once confirmation has been made and agreed on.
7.4 If your payment s not able to be processed Walker Bay (Aust) will contact you to go through details to stop any fraud.
7.5 If details are not given to Walker Bay (Aust) within 7 days of being asked all orders will be cancelled and your payment will be refunded back to the method in which you paid. These procedures are taken protect credit card holders from online fraud.
8. Delivery of Products
8.1 Walker Bay (Aust) tries to ensure that all products ordered are dispatch in a timely manner, it is also possible for different circumstances that there may be delays in delivers. Walker Bay (Aust) does not take any responsibility for loss or damage suffered by anyone as a result of such delays.
8.2 There will be a date of delivery emailed to the nominated email address, this is an estimated time of delivery, if the delivery time is going to delayed for longer than 7 days another email will be sent confirming this.
8.3 Walker Bay (Aust) does not delivery products to Private Address’s or P.O Box Address’s when it comes to major lines of boats or sail kits. Accessories are acceptable.
8.4 Ownership and responsibility will be passed onto the customer once products have been signed for on delivery.
8.5 If a customer gives authority for products to be delivered without a signature Walker Bay (Aust) voids all responsible.
8.6 Couriers use by Walker Bay (Aust) delivery products between (9am-5pm Monday to Friday)
8.7 Once products have been dispatch on our nominated courier the customers will be informed via email to the nominated email provided, Walker Bay (Aust) will not be held responsible for delays in delivery with it comes to dates and times.
9.1 Walker Bay (Aust) offers a 12 month limited warranty on their products, proof of purchase is essential by the way of completing your warranty card or copy of purchase invoice showing authorised seller and date.
9.2 The boat or accessories must be maintained and used in accordance with the compliance plate and the original instruction manual.
9.3 The boat or accessories have not been damaged through neglect, accident, or improper use.
9.4 The boat or accessories have not been altered or operated outside the manufacturer’s specifications.
9.5 Walker Bay (Aust) will not be liable for loss of any kind arising out of the supply or operation of the boat or accessories.
9.6 Should the boat or accessories change ownership during the 12 month warranty period, then
it is the new Owners responsibility to provide proof of purchase for the original purchase by producing a copy of the original purchasers invoice.
9.7 Any works agreed to by Walker Bay (Aust) will be done ex factory: freighting costs to and from the factory will be the purchasers responsibility. (Unless other arrangements are agreed to between the purchaser, seller and Walker Bay (Aust).
9.8 Walker Bay (Aust) reserves the right to offer a repair, replace or refund.
9.8a Consumer warranty does not apply, if you got what you asked for but simply changed your mind, found it cheaper elsewhere, decided you did not like the purcahse or had no use for it.
9.8b Walker Bay (Aust) reserves the right to repair minor problems and should the product be deemed un-repairable then we will offer a replacement. a refund can be obtained if the product is returned with all accessories , in original packaging and never been used alot.

9.10 Warranty Registration can be done simply click on the ‘warranty registration’ tab at the top of our website and submit the completed form.
10. Refunds and Returns
10.1 In order to proceed with a refund or return of product to Walker Bay (Aust) please email firstname.lastname@example.org
10.2 The customer must follow the directions from Walker Bay (Aust) staff.
10.3 Returned products must be packaged with all accessories and returned in a re- saleable state.
10.4 It is the customer’s responsibility to make sure the product is returned safely. Walker Bay (Aust) will take no responsibility for products lost in transit.
11.1 Walker Bay (Aust) will not be liable for any loss, damage, loss of income , loss of profits or any indirect issues caused by negligence.
